Terms of Use

These Terms govern access to and use of the Site, the Play Hall Pass program, and any associated community. By using the Site or purchasing the program, you agree to these Terms, the Privacy Policy, the Disclaimer, and the Refund Policy.

Eligibility

The Site is intended for users at least 13 years old. Users under 18 may purchase only with the involvement of a parent or legal guardian.

Program Purpose

Play Hall Pass and its content are provided for personal, recreational, and educational purposes only. Nothing in the program creates a legal, financial, medical, therapeutic, mental-health, or other professional advisory relationship.

Intellectual Property and License

Unless otherwise stated, all program content — text, graphics, videos, downloads, frameworks, and branding — is owned by or licensed to Yolanda Nichole, LLC and protected by intellectual property laws. When you purchase or access the program, you receive a limited, non-exclusive, non-transferable, revocable license to use it for your own personal use. You may not resell, redistribute, share login access, sublicense, reproduce, or publicly post the program content except as expressly permitted in writing.

User Submissions and Community Conduct

If you submit feedback, testimonials, or other content, you represent that it is accurate and lawful, and you grant Yolanda Nichole, LLC a worldwide, non-exclusive, royalty-free license to use, edit, publish, and promote it in connection with the business, subject to any separate written agreement.

[Community terms — activate when the Play Hall Pass community launches: account registration and security, a community code of conduct, prohibited content and behavior, the license you grant to user-generated posts, and our content-moderation and removal rights. Until then, no public community features are offered.]

Testimonials

When a participant shares a testimonial with permission for public use, we may use that content — along with their name, likeness, and the general experience described — across our websites and marketing materials, with light edits for clarity or length. This permission continues until withdrawn in writing. Testimonials reflect individual experiences and are for illustration only; they do not guarantee similar results.

Purchases and Third-Party Checkout

Purchases are sold through third-party providers — Gumroad and/or Stripe. Payment processing and certain customer-data practices on those checkout pages are governed in part by those providers' own terms and privacy policies. We may refuse, limit, or cancel any order where fraud, misuse, pricing error, policy violation, or operational necessity is reasonably suspected.

Refunds

Refunds, if any, are governed by the Refund Policy.

Disclaimer of Warranties and Limitation of Liability

The Site and program are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. To the fullest extent permitted by law, Yolanda Nichole, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Site or program. Our total liability for any claim will be limited to the amount you actually paid for the program during the three months preceding the event.

Indemnification

You agree to indemnify, defend, and hold harmless Yolanda Nichole, LLC and its owners, contractors, agents, and licensors from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or program, violation of these Terms, infringement of third-party rights, or violation of law.

Termination

We may suspend or terminate access at any time for violation of these Terms, misuse, fraud, or risk to the business or other users. Provisions that by their nature should survive termination — including ownership, warranty disclaimers, indemnity, and limitation of liability — will survive.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Durham, North Carolina, except where applicable law requires otherwise.

General and Changes

These Terms constitute the entire agreement regarding the Site. If any provision is held invalid, the rest stay in effect; our failure to enforce a provision is not a waiver; you may not assign your rights, we may assign ours; you consent to electronic communications; the English version controls over any translation. We may update these Terms with at least 15 days' notice for material changes. Continued use after changes take effect constitutes acceptance. If you do not agree to the new terms, you are no longer authorized to use the Service.
